    Terms of sale

    These Terms of Sale ("Terms") govern every order placed on wyndor.co.uk (the "Site") by a consumer ("you"). They apply between you and MOULARD Timothée, Melchior, Jacques, trading as Wyndor, a sole trader registered in France under registration number 940 676 711 00010, with registered address at 49 Rue Molière, 93100 Montreuil, France ("we", "us", "Wyndor"). These Terms are drafted to be compliant with UK consumer protection law, in particular the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which apply given that our goods are marketed and sold to consumers in the United Kingdom.

    2. Products

    We take reasonable care to ensure that product descriptions, images, and prices on the Site are accurate. Slight variations in colour or appearance may occur due to photography and screen display. Product availability is not guaranteed and may change without notice.

    3. Prices and Payment

    All prices are displayed in pounds sterling (£) and are inclusive of applicable taxes unless stated otherwise. As Wyndor operates under a French VAT exemption scheme for small businesses (Article 293B of the French General Tax Code), no VAT is added to the displayed price.

    Payment is taken at the time you place your order, via the secure payment methods available on the Site. We reserve the right to refuse or cancel an order in cases of suspected fraud or payment failure.

    4. Order Process and Contract Formation

    Your order constitutes an offer to purchase. We will send you an order confirmation email acknowledging receipt of your order; this confirmation does not constitute acceptance. The contract between us is only formed when we send you a dispatch confirmation email indicating that your order has shipped. We reserve the right to decline any order prior to dispatch.

    5. Delivery

    Please refer to our Shipping Policy, available on the Site, for full details on delivery times and costs. In any event, we will deliver your order within 30 days of the contract being formed, unless a longer period has been expressly agreed.

    6. Your Right to Cancel (Statutory Cooling-Off Period)

    As a UK consumer, in addition to our own Return and Refund Policy, you have a statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order without giving any reason within 14 days of receiving your goods.

    To exercise this right, you must inform us of your decision to cancel by a clear statement (for example, by email to hello@wyndor.co.uk) before the cancellation period expires. You then have a further 14 days from the date you notify us to return the goods to us.

    Return costs: unless the goods are faulty or not as described, you will be responsible for the direct cost of returning the goods to us, in accordance with our Return and Refund Policy.

    Refunds: we will refund you within 14 days of receiving the returned goods back, or of you providing evidence that you have sent the goods back, whichever is earlier, using the same payment method you used for the original transaction.

    The right to cancel does not apply to goods made to your specification or clearly personalised, goods liable to deteriorate or expire rapidly, or sealed goods which are not suitable for return due to health protection or hygiene reasons if unsealed after delivery, to the extent such products are sold on our Site.

    7. Returns and Refunds — Change of Mind

    In addition to your statutory cancellation right above, we offer a 14-day return policy from the date of delivery for a change of mind, as set out in full in our Return and Refund Policy. Return shipping costs are the responsibility of the customer, except where the goods are faulty, damaged, or not as described.

    8. Your Statutory Rights — Faulty or Misdescribed Goods

    Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015. If the goods you receive are faulty, not as described, or not fit for purpose, you are entitled, subject to the conditions of the Act, to:

    • A repair or replacement, or
    • A price reduction or a refund, particularly where a repair or replacement is not possible or has failed

    In particular, you have a short-term right to reject faulty goods and obtain a full refund within 30 days of delivery in most cases. Where goods are faulty, not as described, or otherwise not compliant with the Consumer Rights Act 2015, we will bear the cost of return shipping.

    9. Risk and Ownership

    Risk in the products passes to you upon delivery. Ownership of the products passes to you once we have received payment in full.

    10. Our Liability

    We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not liable for any loss or damage that is not foreseeable. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded or limited by law.

    11. Complaints and Alternative Dispute Resolution

    If you are unhappy with your order or with our service, please contact us in the first instance at hello@wyndor.co.uk so that we can try to resolve the issue directly.

    We are not currently signed up to any Alternative Dispute Resolution (ADR) scheme; however, this does not affect your right to bring a claim through the courts or to use the UK courts' small claims procedure where applicable.

    12. Governing Law and Jurisdiction

    These Terms are governed by French law. If you are a consumer habitually resident in the United Kingdom, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may bring proceedings in relation to these Terms in the courts of the United Kingdom or in the competent French courts.

    13. Changes to These Terms

    We may update these Terms of Sale from time to time. The version applicable to your order is the version published on the Site at the time you place your order.
